You filed your Indian tax return as an NRI, the return was processed, and a refund is due. But the money never arrives. One of the most common reasons is that your PAN has quietly become inoperative. The good news: it can be fixed.
Why would an NRI's PAN become inoperative?
Residents had to link PAN with Aadhaar, and PANs not linked became inoperative. NRIs do not have to link, but only if the tax department knows you are a non-resident.
The department treats you as a non-resident if either of these is true:
- You filed a return as a non-resident in any of the last three years.
- You informed your Assessing Officer of your non-resident status.
If neither happened, the system may still treat you as a resident who did not link Aadhaar, and mark your PAN inoperative.
What an inoperative PAN does to you
An inoperative PAN is not cancelled. You can still file your return. But:
- Your refund is not paid while the PAN is inoperative.
- No interest is paid on the refund for that period, and that interest is lost even after you fix it.
- TDS and TCS on your income can be cut at higher rates.
How to check and fix it
- Check your PAN status on the income tax e-filing portal using the Verify Your PAN service.
- If you have no Aadhaar, write to your Jurisdictional Assessing Officer (find them through the Know Your AO service) asking them to update your status to non-resident. Attach a copy of your PAN and your passport showing your time outside India.
- If you do have an Aadhaar, you can link it online after paying the late fee. The PAN becomes operative within about 30 days, and the refund is then released.
The sooner you fix it, the less refund interest you lose.
