Quick answer
What are sections 44AD and 44ADA?
They let small businesses declare 6% or 8% of turnover, and professionals 50% of receipts, as taxable income without detailed books, within set limits. The 5-year lock-in applies only to 44AD.
Many freelancers and consultants file ITR-3 with a full profit and loss statement and detailed books, with all the effort that comes with it. If your receipts are under the limit, you probably do not need to.
Section 44ADA for professionals
If you are a resident in a specified profession (such as doctor, lawyer, architect, engineer, accountant or technical consultant) and your gross receipts are up to ₹75 lakh, you can declare 50% of receipts as your taxable income. The ₹75 lakh limit applies when cash receipts are no more than 5% of the total; otherwise the limit is ₹50 lakh. No detailed books, and no audit.
If your actual expenses are less than 50% of receipts, presumptive taxation may mean paying more tax than you need to. If your expenses are more than 50%, it usually saves you tax and a lot of paperwork.
Section 44AD for small businesses
Resident individuals, HUFs and partnership firms (not LLPs) with business turnover up to ₹3 crore, where cash receipts are no more than 5% of the total, can declare 6% of digital receipts and 8% of cash receipts as taxable profit. Otherwise the turnover limit is ₹2 crore. Again, no detailed books and no audit.
The catch nobody talks about
This rule applies to section 44AD only, not to 44ADA. If you use 44AD and then opt out in any of the next five years by declaring lower profit, you cannot use 44AD again for the following five years. In those years, you also need a tax audit if your income is above the basic exemption limit.
For most consultants with predictable revenue and low expenses, presumptive taxation is the right call. For early-stage businesses with volatile margins, it may be better to keep regular books until things settle.
From tax year 2026-27, the Income-tax Act, 2025 applies. These schemes continue, with new section numbers.
